Participation Terms for the BIOGENA ONE Referral Program
1. Responsible Party for the BIOGENA ONE Referral Program and the Referral Bonus
The BIOGENA ONE Referral Program (ONE RP) allows for the recommendation of the BIOGENA ONE product for purchase to family and friends. The ONE RP is offered and executed by Biogena GmbH & Co KG, Strubergasse 24, 5020 Salzburg, Austria (BIOGENA). BIOGENA is the responsible entity in accordance with Art. 4 No. 7 of the General Data Protection Regulation (GDPR). 2. Eligibility for Participation
2.1
Only existing customers of BIOGENA who are natural persons ("existing customers") are eligible to participate in the ONE RP. Existing customers who send or share a referral code with third parties within the scope of this program are referred to as “Referrers”. The recipients of such a referral code are referred to as “Referred Persons”.
2.2
The referrer/referring person and the referred person must be two different natural persons, both of whom must be at least 18 years old and reside in one of the European countries where BIOGENA ONE is sold to via the website www.biogena-one.com.
2.3
Referrers cannot refer themselves to participate in the ONE RP.
2.4
BIOGENA reserves the right to exclude individuals from participation at its own discretion if there are valid reasons that make participation unreasonable for BIOGENA (e.g., Referrers and Referred Persons cannot refer each other mutually).
3. Referral Process
3.1
BIOGENA ONE buyers, who have bought a product on www.biogena-one.com, can visit the sign-up page for the ONE RP and sign-up to the program by accepting the terms and conditions - thus becoming a Referrer.
3.2
The referrer can generate a personal referral code that is linked to the Referrer’s email address.
The referral code may only be shared by the referrer to individuals who are eligible for participation (see aformentioned criterias). Mass solicitation is prohibited (see 4.2).
3.3
Referred persons can use the referral code to purchase one discounted BIOGENA ONE starter bundle product on the website www.biogena-one.com. The referral code must be manually entered during the check-out on the website and will realize an immediate discount on the purchase. Once the request is created, the relationship between the referring person and the referred person is established and stored based on their email addresses.
3.4
If the referral code was not used during the purchase process, it can not be entered nor attributed later on. In this case the referral discount is not applied on the purchase, no connection is established and the referrer is not entitled to claim a referral bonus.
4. Position and Obligations of the Referrer
4.1
Referrers are not integrated into the organization of BIOGENA and BIOGENA has no authority to give them instructions.
4.2
Referrers are not obligated to promote, advertise, or take any action within this program. Participation is voluntary and solely at the referrer’s discretion.
Participation in the ONE RF does not establish an employment relationship.
4.3
Referrers may only use the referral code for personal, non-commercial purposes.
The referral code must not be used for commercial activities, including:
- • Paid advertising campaigns
- • Online advertising
- • Public distribution on websites, social media, blogs, or forums primarily created to collect referral bonuses
- • Mass emails, SMS, or automated messages/bots
5. Claiming discounts and Bonus
5.1
The referral bonus for the referred person is a discount code for a BIOGENA ONE starter bundle for their first purchase. The code will only work for new customers – who have no previous purchase under their email address on www.biogena-one.com (see 2.)
5.2
The referral bonus for the referring person can be a discount code for a product or a voucher code for a purchase on http://www.biogena-one.com or http://biogena.com. BIOGENA will provide changing referral boni and inform referrers during their sign-up for the ONE RF and also afterwards via email on the current boni. BIOGENA is not obliged to deliver the exact promised bonus but will provide boni with a similar value.
5.3
The right to claim the discount as new customer arises once the referred person receives a referral code by the referring person.
The right to claim the referring person’s bonus arises arises once the referred person has successfully placed an order with the provided discount code and after the order has been shipped. The referring person will be notified by email on this event and details on the process for redemption will be provided.
5.4
The personal code of the referrer will stay valid until further changes to the program are announced.
The redemption of the referring bonus must take place within 30 days after the eligibility for the bonus was initiated (see 5.3).
Both discount code and referrer bonus can not be payed out in cash.
6. Data Protection
Referrers and Referred Persons accept the privacy policy of BIOGENA.
7. Liability
BIOGENA is not liable for damages caused by transmission errors, service failures, incorrect information, or data loss, except in cases of intentional misconduct or gross negligence.
8. Termination of the Referral Program
Either party may terminate the program with a three-month notice period.
9. General Provisions
BIOGENA may modify or discontinue the program at any time. Changes will be published, and participants may object within 4 weeks.
The ONE RF is governed by Austrian law.
